These Terms and Conditions ("Terms") govern your use of the NexaCare website and the property care services provided by NexaCare, a division of Nexelica ("we", "our", "us"). By accessing our website or engaging our services, you agree to be bound by these Terms.
1. About NexaCare
NexaCare is a structured property care company operating as a division of Nexelica. We provide professional cleaning, hygiene, mobile vehicle detailing, and specialised property care services to residential estates, private homes, corporate environments, and fleet operations in South Africa.
2. Use of This Website
By accessing and using the NexaCare website, you agree to:
- Use the website for lawful purposes only.
- Not reproduce, distribute, or commercially exploit any content without prior written consent.
- Provide accurate and truthful information in any forms or enquiries submitted.
- Not attempt to interfere with, disrupt, or compromise the website's security or functionality.
3. Service Enquiries & Quotations
Information submitted through our website contact forms or via email to info@nexacare.nexelica.co.za constitutes a request for information only. Submitting an enquiry does not create a binding agreement or guarantee of service. All quotations provided by NexaCare are:
- Valid for a period of 30 days from the date of issue, unless otherwise stated.
- Subject to a site assessment and final scope confirmation.
- Non-binding until a formal service agreement is signed by both parties.
4. Service Agreements
All NexaCare services are governed by a separate written service agreement between NexaCare and the client. This agreement will detail:
- Scope of services and deliverables.
- Service schedule, frequency, and duration.
- Pricing, payment terms, and invoicing schedule.
- Cancellation and termination provisions.
- Liability limitations and indemnification.
These Terms do not replace any provisions in a signed service agreement. In the event of a conflict, the service agreement shall prevail.
5. Pricing & Payment
- All prices are quoted in South African Rand (ZAR) and are exclusive of VAT unless otherwise stated.
- Payment terms are as specified in the service agreement — typically due within 7–30 days of invoice.
- Late payments may incur interest at a rate of 2% per month on outstanding amounts.
- NexaCare reserves the right to suspend services where payments are overdue by more than 30 days.
6. Cancellation & Rescheduling
- By the client: Service sessions may be cancelled or rescheduled with at least 48 hours' notice at no additional charge. Cancellations with less than 48 hours' notice may incur a cancellation fee of up to 50% of the scheduled service cost.
- By NexaCare: We reserve the right to reschedule services due to unforeseen circumstances (weather, emergencies, force majeure), in which case we will provide reasonable alternative arrangements at no additional cost.
7. Quality & Liability
NexaCare is committed to delivering services to the highest professional standards. However:
- We are not liable for pre-existing damage to property, surfaces, or items not disclosed during the site assessment.
- Clients are responsible for securing or removing valuables and fragile items prior to scheduled service visits.
- Any concerns regarding service quality must be reported within 24 hours of service delivery. NexaCare will conduct a re-inspection and rectify any valid issues at no additional charge.
- Our total liability for any claim shall not exceed the value of the specific service that gave rise to the claim.
8. Intellectual Property
All content on this website — including text, graphics, logos, images, icons, and code — is the property of NexaCare / Nexelica and is protected by South African and international intellectual property laws. You may not reproduce, modify, distribute, or use any content without our prior written consent.
9. Third-Party Links
Our website may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of those third-party sites. Accessing them is at your own risk.
10. Limitation of Liability
To the fullest extent permitted by South African law:
- NexaCare shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or services.
- We make no warranties regarding the uninterrupted or error-free operation of our website.

11. Indemnification
You agree to indemnify, defend, and hold harmless NexaCare, Nexelica, and their directors, employees, and agents from any claims, damages, liabilities, or expenses arising from your use of our website or breach of these Terms.
12. Force Majeure
NexaCare shall not be liable for any failure or delay in performing services due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, civil unrest, government restrictions, power outages, or severe weather conditions.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.

NexaCare reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
